본연구는 진로교육과 아동권리에 대한 문헌을 살펴보고, 우리나라의 국가적 수준의 진로교육 정책에 대하여 UN 아동권리협약에 제시된 아동권리 관점에서 분석하였다. 우리나라는 2015년제정된 진로교육법의 명시적 법적 근거에 의해 진로와 관련한 교육적 지원이 이루어지고 있고 소외계층 대상 진로교육 방안이 제시되고 있다. 아동권리와 관련 해서는 비차별의 원칙, 생존과 발달의 권리, 발달권, 보호권 보장 관련 조항이 진로교육법에 포괄적으로 명시되어 있다. 본연구의 결과, 우리나라 국가적 수준의 진로교육 정책은 비차별의 원칙, 생존과 발달의 권리, 발달권 보장에 대해서는 관련 정책이 반영되어 있고 세부 정책과제 또한 제시되어 있었다. 그러나, 아동 의견 존중, 아동 최선의 이익, 참여권, 보호권과 관련해서는 정책적 반영이 미흡하게 나타났다. 특히, 사회적 배려대상자에 대한 비차별의 원칙, 생존권, 발달권 보장을 위한 정책은 제시되어 있어도, 사회적 배려대상 아동의 의견 존중, 아동 최선의 이익, 참여권 보장과 관련한 정책은 미흡하게 나타나고 있어 이에 대한 정책 마련이 필요하다. 진로교육 관련 정책에 있어서 사회적 배려대상 아동들에게 진로교육의 기회를 제공해주는 정책적 지원을 넘어 사회적 배려대상 아동들의 의견이 존중되고 진로교육 참여에 있어 그들이 주체가 될수 있도록 하는 정책이 제시될 필요가 있다. 사회적 배려대상 아동의 의견 존중, 최선의 이익, 참여권이 보장될 수있도록 하는 정책 수립이 되어야 하고, 이러한 과정 을통해 수립된 진로교육 정책의 구현은 진로교육 격차 감소의 결과를 기대할 수있다.

This study reviewed the literature on career education and children's rights, and analyzed Korea's national career education policy from the perspective of children's rights presented in the UN Convention on the Rights of the Child. In Korea, career-related educational support is provided based on the explicit legal basis of the Career Education Act enacted in 2015, and career education plans for underprivileged groups are being proposed. Regarding children's rights, the principles of non-discrimination, rights to survival and development, rights to development, and provisions related to guaranteeing protection rights are comprehensively specified in the Career Education Act. As a result of this study, Korea's national career education policy reflects related policies regarding the principle of non-discrimination, the right to survival and development, and guaranteeing the right to development, and detailed policy tasks were also presented. However, there was insufficient policy reflection in relation to respect for children's opinions, children's best interests, participation rights, and protection rights. In particular, although policies to ensure the principle of non-discrimination and the right to life and development of those subject to social consideration are proposed, policies related to respecting the opinions of children subject to social consideration, the best interests of children, and guaranteeing participation rights are insufficient. Arrangements are needed. In policies related to career education, there is a need to go beyond providing policy support to provide career education opportunities to children subject to social consideration, and to propose policies that ensure that the opinions of children subject to social consideration are respected and that they can take the lead in participating in career education. there is. Policies must be established to ensure that the opinions, best interests, and participation rights of children subject to social consideration are respected, and the implementation of career education policies established through this process can be expected to result in a reduction in the career education gap.
